Insolvency and vat registration

Hi, 

hope someone can help with a query I have. If someone has previously been vat registered and been made insolvent none ltd company 1 year ago who is trading again now, can they apply to be vat registered again and would the vat debt that they had before going bankrupt come back to bite them in the bum ????

Hi Becky

If they have been discharged from their bankruptcy then the debt is written off and HMRC would not be able to pursue them for that debt.

There are certain circumstances can revisit the debt but these tend to be exceptional or unusal cicumstances.

However HMRC are within their rights to ask for a security deposit especially if they a voluntarily register.
