CIS or not CIS that is the question!

One of my Limited Company clients is having an office built in his garden to be used solely for the business.  The roofer taken on to help has invoiced my client for work but deducted CIS tax.  Is this correct?  My client is a CIS Contractor but does he need to verify this worker?

I'd ring the HMRC CIS Helpline as they can be very helpful.  Your client hasn't sub-contracted as such to this roofer so I'd have thought not but as he is a CIS contractor maybe that supercedes....

I think you need to ask who was invoiced - your client's company or your client personally. If it was your client personally as Joe Public, then there isn't any CIS. If your client's company was invoiced, then there would be CIS. There would also be capital gains when/if the property is sold as it is a dedicated office.

Thank you for your responses.  I didn't bother calling HMRC because that would be a long long wait to speak to someone!  The sub contractor invoiced the company so CIS was rightly deducted.  Smile
